I believe most of us have read the news about this private road in Clementi in which one of the owner demanded $500 for the release of wheel-clamp for someone who illegally parked his car there. I can understand the frustrations of the home owners but I also feel that the amount is exorbitantly high. 

In the recent news report, it was found that home owners do not actually owned the road and they have put up a chain to prevent non-residents from entering the road. IMHO, they have no rights to 1) chain up the entrance, 2) wheel clamp vehicles and 3) demanded for $500 to release the clamps since they are wrong in terms of ownership.  


What is your opinion and what will you do if it happens that your car is being wheel clamped?

There is another news paper report I read somewhere which state that they actually purchase the road. And police was called in but cannot do anything. We just have to be careful, anyway $500 is really too high......

Based on ST papers last few days, the home owners didn't purchase the road. The road is actually owned by a private company and the home owners are given access rights, i.e. they can use the road to gain access to their homes. If this is true, then the residents really do not have the rights to wheel clamp illegally parked vehicles, nor do they have the right to collect $500 to release the clamps.

I was also thinking that if I am the unfortunate one who kena wheel clamped, i might just call a tow truck and tow my vehicle to a workshop where they can remove the clamp. Sure I may have to change rim, tyres and brakes during the removal, but at least I don't let the residents do as they want. They will have to buy another wheel clamp. What a Face

I saw in STOMP. there was a huge sign stating that it was a private rd. any un-authorized vehicle parked there will be clamped & fined $500. I think the driver deserve it but $500 is really too much. The son of of home owner said that they did not purchase the road, they as residents exercised their rights (or something). And seems like the police did came and couldn't do anything abt it cos the LTA or some authority said they can do it. $$$$ go where? Not stated.

Yes, that is what I read also, anyway for sure $500 is way too much.

replace the clamped tire with you spare tyre, then drive to somewhere, pay $20 to cut open the lock to the wheel clamp

The last time one Malaysian car was clamp, what he did was
surprising and he must be a contractor with ready tools in his car,
he actually saw off the clamp and drove!!

Left the clamp for the owner to take it back!

Since the owners are taking the law into their own hands, I would probably engage a subcontractor to cut off the wheel clamp lo. See what the owners can do. Wheel clamp also damaged.Laughing

We have to be in the resident's shoe to fully understand their pain or trouble when other car owners illegally park the cars along that road ie block your gate area where ur car is parked, used ur parking area (Singaporean own more than 1 car per house) etc making ur daily home coming a pain.....

Singaporeans are "rich" if u enforce $200 or $300 to release the clamp, they dun feel the pinch; maybe that why the resident set $500 to deter any potential car owner from illegally parked along that stretch of "lim peh road".

At least now people are aware there are private roads here. LTA do not repair or upgrade all roads in sg for free. There are roads where they did widening and bill to residents.

I think we have to get the facts right first.  The road is owned by a defunct company, thus making it a private road. Unfortunately, the OA had not re assigned the road to the State, thus the government does not own the road as well.  As for the residents, they have the right to the road as an easement act.

I quote:

Looking at the picture, most if not all the terrace houses have very small front porch, which means some can't park their cars inside their gates, the road becomes the only place for them to park. I can imagine myself coming home late after a long day of work, and, can't find a place to park in front of my own house.. How frustrating that would be..

Therefore, I totally agree with what the residents do, if the public cannot heed the huge and largely visible warning signs the residents put up, then they fully deserve to have their cars clamped....

Fact is: the residents do NOT own the road. They only have right of easement; i.e. use of road to access their houses. Having easement rights does not confer upon them title to that road. Simply put, they do not own that road & thus do not have rights to claim it is "their" private road.

While I can empathise with the residents on the inconvenience caused by illegal parking, they simply can't claim ownership of that road UNLESS they're able to produce title to that effect. Just becos that road is outside your house doesn't mean you own it even if illegal parking is causing you huge problems. The logical thing to do is to approach the authorities to deal with it, not take matters on yr own.

Sorry if I ruffle a few feathers with my take on this; seriously, if it's not your road it is not.

Twisted Evil Just wondering aloud.....

Did those house owners consider what their actions might lead to?? That road would probably be vested to the State as the company owning it has been struck off. What would happen then? The Govt declares & gift that road to all those house owners so that they can erect a barrier & wheel clamp indiscriminately illegally parked cars & allow them to charge & pocket fees to remove wheel clamps? Let u keep the road cos yr carporch Is too small??

Get real, we know what will happen. Car park lots will be drawn & fines imposed. These house owners won't get to keep a single cent of those fines imposed.  We know who will be the real winner......

I think you're barking up the wrong tree...and the simple solution is to stop parking illegally....if LTA has said that the residents have the right to do so, then so be it....it seems that us drivers will only follow rules if there are penalties involved.....i completely understand the residents' frustrations and while not supporting a $500 wheel clamp, feel that this was something done as a last resort.....

I'd rather empower them to just write parking tickets to all those idiots who are parking illegally.....of course, that will open up a completely new can of worms......

I agree with some brothers' comments. As drivers, we have to be considerate to others and not behave as if we own the road and therefore entitle ourselves to do whatever we want.

I have a good friend whose brother-in-law owned a bungalow along Holland Road just after Queensway junction way back in 1981. They have a very long driveway (at least about 50m if I am not mistaken). Our Government took back one big chunk of the driveway land for widening the congested road. Compensation was miserable back then because the land was used for public road. Many house owners were also affected.

@Golfool2009, Unless the road has been vested to the State, LTA has no jurisdiction nor the legal right to allow the house owners to do as they deemed fit. I do not condone the actions of those parking illegally & I'm certainly not barking up the wrong tree. Pray tell, what rights do these owners have over that road other than the right of easement? 

This goes to show the ugly side of some; 2 wrongs just don't make 1 right. Those parking illegally are wrong; same goes for the house owners in wheel clamping & claiming the road for themselves.  All of us have a part to play in making our soceity a gracious one.
